1. Who We Are & Our Marketplace Role

The Vacation Code is an online travel planning marketplace and technology platform. Itineraries are hand-crafted by verified independent travel curators. Tour packages, hotel stays, and activity tickets are supplied or operated by vetted third-party vendors. We provide curation standards, automated verification engines, and secure checkout systems that connect travelers directly with direct partner rates without agency markup.

2. Account Registration & Security Obligations

You must provide accurate, complete registration details and maintain password security. You are solely liable for all transactions executed through your account credentials. Account registration is restricted to individuals aged 18 or older. We reserve the right to suspend accounts engaged in referral exploitation, fraud, or bot automation.

3. Digital Itinerary End-User Licence Agreement

Upon unlocking a digital itinerary, The Vacation Code grants you a limited, personal, non-exclusive, non-transferable, revocable licence to view and use the itinerary content for your personal travel group. You may not copy, republish, resell, scrape, or commercially redistribute itinerary routes, custom POI databases, or curator notes.

4. Tour Bookings & 30-Minute Soft-Hold Seat Policy

All tour package listings display transparent inclusions, exclusions, and departure dates. We enforce a statutory 30-Minute Soft-Hold Seat Reservation Rule during checkout:

• Initiating a booking reserves seats on temporary hold for exactly 30 minutes.
• If checkout payment is not completed within 30 minutes, the hold expires automatically and inventory returns to public availability.
• Bookings are confirmed only upon successful gateway payment authorization. On-ground execution (transportation, hotel check-ins, local guides) is managed by contracted destination vendors.

5. Pricing, Taxes & Razorpay Gateway Authorization

All prices are quoted in INR (Indian Rupee) inclusive of applicable Goods and Services Tax (GST) unless indicated otherwise. Payments are authorized via **Razorpay** (PCI-DSS Level 1 Gateway). Where a tour permits payment installments, final balance amounts must be cleared prior to departure cut-off dates to prevent automatic cancellation.

6. Travel Club Subscriptions & Auto-Renewal

Travel Club subscriptions renew automatically at the end of each billing cycle (monthly or annually) until cancelled via your profile dashboard. Subscriptions can be cancelled at any time to prevent future billing. Past subscription fees are non-refundable, subject to our statutory 48-Hour Unused Grace Period.

7. Loyalty Coins & Promotional Credits

Loyalty coins and referral rewards represent non-monetary promotional credits with no cash value. They cannot be transferred, exchanged for currency, or assigned. We reserve the right to audit, cap, or revoke coins in cases of fraudulent referral schemes.

8. Traveller Responsibility: Visas & Insurance

While our platform provides destination visa information summaries, obtaining valid visas, maintaining passport validity (minimum 6 months from entry date), complying with health protocols, and obtaining travel insurance remain your sole personal responsibility. We bear no liability for immigration rejections or flight denials.

Neither party shall be liable for non-performance or cancellation caused by events beyond reasonable control, including acts of God, severe weather, landslides, civil commotion, border lockdowns, pandemics, strikes, or sudden government restrictions.

11. Governing Law, Arbitration & Court Jurisdiction

These Terms are governed by the laws of India. Any unresolved dispute or claim arising out of these Terms shall be referred to and finally resolved by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. Subject to arbitration, exclusive legal jurisdiction resides with the competent courts located in the city of our corporate registered office.
